The underlying purpose of the Residential Care and Disability Support Services Act 2018 is to specify the circumstances in which certain older persons are required to pay for and a funder must contribute towards long-term residential care. The availability of support is subject to means assessment to determine if, and how much, a funder must contribute towards the cost of long-term residential care. The Act ensures that financial support provided takes into account, that “where appropriate, they should use the resources available to them before seeking financial support”. Those resources may include assets held in a trust.
